HOA Special Assessment Notice Template
A special assessment is a one-time levy on owners outside the regular budget — typically used to cover an uninsured loss, an underfunded reserve project, or an emergency repair the operating fund can't absorb. It's also one of the most procedurally fragile actions a board takes: most state HOA acts and most Bylaws require either a defined notice period, a member vote, or both, depending on the dollar amount per unit.

When to use
Send this notice when the Board has either (a) adopted a special assessment within its independent authority under the Bylaws and statute, or (b) is calling a member vote on a special assessment that exceeds the Board's independent authority. Confirm both the dollar threshold and the procedural path before drafting — the wrong path invalidates the assessment and forces a re-vote.
How to use this template

Confirm whether your state caps board-set special assessments. California (Davis-Stirling), Florida 720, and several others allow boards to act independently up to a defined percentage of the operating budget; above that, a member vote is required.

State the [PURPOSE] specifically. 'Pool resurfacing' is enforceable; 'capital repairs' is not. Owners are entitled to know what they're being assessed for.

Calculate the amount per unit consistently with the assessment formula in the Declaration. Equal-share, square-footage, and value-based formulas all exist; using the wrong one is a common challenge ground.

Set the payment terms (single payment, instalments, lien date if unpaid) explicitly. Open-ended payment terms create collection problems later.

Confirm the notice lead time matches your Bylaws and state statute — the longer of the two governs. Some states require minimum 30-day notice for any assessment that exceeds a defined threshold.

Review with counsel before sending. Special assessments are one of the most frequently challenged board actions. State HOA acts (Davis-Stirling §5605, Florida 720.315, NRS 116.3115, etc.) cap board-set special assessments at defined thresholds, prescribe notice form and lead time, and define when a member vote is required. Exceeding the threshold without a vote, or underdelivering the notice, voids the assessment and exposes the Board to fee-shifting in any subsequent collection action.
