HOA Cease and Desist Letter Template

A cease and desist letter is the last informal step before a board has to either levy fines under hearing rights or refer the matter to counsel. It puts the owner on notice that the board has documented the prior attempts to resolve the issue and is prepared to escalate.

When to use

Use this template after at least one prior violation notice has gone unanswered or the violation has not been cured. The letter should reference the prior notices by date, restate the cited section, and make clear what specifically must stop and by when. Don't use it as a first-contact letter — that's what the violation notice is for.

How to use this template

    List every prior notice or contact by date in the body. The paper trail is the whole point of this step.

    Restate the [CITED SECTION] from the governing documents — the same section cited in the original violation notice.

  3. 3

    Be specific about the conduct that must cease. 'Stop the violation' is not enforceable; 'remove the unapproved fence within fourteen (14) days' is.

    Send by certified mail with return receipt (or whatever method the CC&Rs and state statute permit) and keep the receipt in the violation file.

  5. 5

    Calendar the deadline. If the owner does not cure, the next step is a formal hearing notice — not another cease and desist.

Dear [OWNER NAME]:

This letter is a formal demand that you immediately cease and desist the
ongoing violation of [CITED SECTION] of the [HOA NAME] [Declaration / Rules
and Regulations / Architectural Guidelines], and that you cure the violation
on or before [CURE DEADLINE].

The violation. The Board has documented the following ongoing condition at
the above-referenced property: [SPECIFIC DESCRIPTION OF THE ONGOING CONDUCT
OR CONDITION — be precise and observation-based].

Prior notices. The Board has previously notified you of this violation:

  • [DATE] — Notice of Covenant Violation (sent by [METHOD]).
  • [DATE] — [Follow-up letter / phone call / hearing offer], to which no
    response was received.
  [Add additional contacts, each with date and method.]

The cited section provides: [QUOTE OR PARAPHRASE THE GOVERNING-DOCUMENT
LANGUAGE.]

Demand. To avoid further enforcement action, you must:

  1. Cease the violating conduct immediately, including [SPECIFIC ACTION,
     e.g., "removing the unapproved fence and restoring the lot line to its
     prior condition"].
  2. Complete the corrective action by [CURE DEADLINE].
  3. Provide written confirmation of compliance to [HOA CONTACT] at
     [HOA EMAIL] no later than [CURE DEADLINE].

If the violation has not been cured by [CURE DEADLINE], the Board intends to
take one or more of the following actions, as authorised by the governing
documents and applicable state law:

  • Schedule a hearing under [BYLAWS SECTION REF] and impose a fine of up to
    [FINE AMOUNT] per [VIOLATION / OCCURRENCE / DAY].
  • Refer the matter to the Association's counsel for further enforcement,
    which may include the recovery of attorneys' fees and costs as permitted
    by [CITED SECTION] or applicable state statute.
  • Suspend [PRIVILEGES — e.g., "common-area access privileges"], to the
    extent the governing documents and applicable state law permit.

Right to a hearing. If you dispute the violation or have circumstances the
Board should consider, you may request a hearing in writing, sent to
[HOA CONTACT] at [HOA EMAIL] or [HOA MAILING ADDRESS], within [HEARING
REQUEST WINDOW] of the date of this letter. A hearing will be scheduled
before any fine is imposed.

This letter is sent in good faith and without prejudice to any of the
Association's rights and remedies under the governing documents or
applicable law, all of which are expressly reserved.

Review with counsel before sending. Cease and desist letters can carry legal weight in subsequent proceedings — the recipient may keep this letter to demonstrate the Association's position. Make sure the cited section, the prior-notice dates, and the threatened actions are all accurate. Do not threaten remedies the Board cannot actually pursue (for example, suspending access to amenities the governing documents protect as a member right).
